All services are subject to a written or verbal agreement between Master Port Arthur Deck & Fence and the customer prior to work beginning. Nothing on this Site constitutes a binding offer or contract for services. Descriptions of services on this Site are for informational purposes only.
Any estimate provided by Master Port Arthur Deck & Fence is valid for the period stated in the written estimate, typically 30 days from the date of issuance. Estimates are based on the scope of work as described at the time and are subject to change if the scope changes.
Final pricing is confirmed in writing before work begins. If unforeseen conditions are discovered during a project that require additional materials or labor, we will notify you before proceeding with any work that would increase the cost.
Pricing shown in any promotional materials or on this Site is for illustrative purposes only and does not constitute a binding price for any specific project.
Project start dates are confirmed in writing or by phone once a deposit has been received and the permit (if required) has been approved. Start dates are estimates and may be affected by weather, permit delays, material availability, or other factors beyond our control.
If you need to cancel or reschedule a confirmed project, please notify us as soon as possible. Cancellations made after a deposit has been paid and materials have been ordered may result in forfeiture of some or all of the deposit to cover costs already incurred.
We reserve the right to cancel or reschedule a project due to unsafe weather conditions, permit issues, or other circumstances outside our control. In such cases, we will reschedule at the earliest available date that works for both parties.
Payment terms are outlined in the written project agreement. In general, a deposit is due before work begins, progress payments may be required for larger projects, and a final payment is due upon completion.
Accepted payment methods are confirmed at the time of your agreement. Invoices not paid within the agreed period may be subject to a late payment fee as specified in the project agreement.
A lien may be placed on the property if payment is not received in accordance with the agreed terms, as permitted under applicable TX law.
Where required by local law, Master Port Arthur Deck & Fence will apply for the necessary building permits on the customer's behalf. Permit fees are the responsibility of the customer and will be itemized in the project estimate.
We will not begin permitted work until the permit has been approved. Required inspections are scheduled by us and are included as part of the project. The customer agrees to allow reasonable access to the property for inspections.
The customer agrees to provide clear access to the work area before work begins, including removing furniture, stored materials, pets, and any items in or around the project zone.
The customer is responsible for disclosing any known site conditions that may affect the work, including underground utilities, drainage issues, property line locations, or existing structural problems. Failure to disclose known conditions that result in additional costs may require a change order at the customer's expense.
We warrant our workmanship against defects in labor for one year from the date of project completion. This warranty covers issues that arise from how the work was performed, not from normal weathering, wear, or conditions outside our control.
Materials and products used in your project may be covered by the manufacturer's own warranty. We will provide available warranty documentation for materials at the time of project completion.
This warranty does not cover damage from storms, flooding, impact, misuse, modifications made by others, or failure to follow any maintenance instructions provided at project completion.
To the fullest extent permitted by applicable law, Master Port Arthur Deck & Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising from our services or from your use of this Site.
Our total liability for any claim arising from services provided shall not exceed the total amount paid by the customer for the specific project giving rise to the claim. This limitation applies regardless of the theory of liability.
This Site is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Information on this Site is for general purposes only and may not reflect the most current service details, pricing, or availability.
If a dispute arises between you and Master Port Arthur Deck & Fence, we encourage you to contact us first so we can try to resolve it directly. Most concerns can be resolved quickly with an honest conversation.
If a dispute cannot be resolved informally, it shall be resolved by binding arbitration in Port Arthur, TX, under the rules of the American Arbitration Association. You agree to waive any right to a jury trial for claims arising under these Terms.
These Terms and Conditions are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the courts of Jefferson County, Texas.
We reserve the right to update or modify these Terms at any time. Changes will be effective when posted to this page with an updated effective date. Your continued use of this Site or our services after any changes constitutes your acceptance of the revised Terms.
